Welcome to Sjoe Daily (“we”, “us”, “our”). We operate this website and online store, including all related information, content, features, tools, products and services (the “Services”), to provide you with a seamless shopping experience. Our store is hosted on Shopify, which enables us to provide these Services to you.

These Terms of Service (“Terms”) outline your rights and responsibilities when accessing or using our Services. By using our website, browsing our store, or purchasing from us, you agree to these Terms and our Privacy Policy. If you disagree with any part of these Terms, you should not access or use the Services.

SECTION 1 – ACCESS AND ACCOUNT

By using the Services, you confirm you are at least the age of majority in your country of residence and have consented to allow any minor dependents to use the Services on devices you control.

To access certain features (including placing orders), you may be required to provide accurate and complete information such as your email address, payment details and shipping information. You are responsible for:

We aim to display our products accurately, but colours or appearance may vary depending on your device or screen settings.

We do not warrant that the quality, appearance, or characteristics of any product will meet your expectations.

Product descriptions, formulations, pricing, packaging and availability may change without notice. We may also limit product quantities or restrict sales on a case-by-case basis.

SECTION 3 – ORDERS

By placing an order, you make an offer to purchase. We reserve the right to accept or decline orders at our discretion. An order is only accepted once payment has been processed and we send an order confirmation.

If we decline, adjust, or cancel an order, we will attempt to notify you using the contact details provided at checkout.

All purchases are subject to our Returns & Refunds Policy.

You represent that your purchases are for personal use only—not for resale or commercial distribution.

SECTION 4 – PRICES AND BILLING

Prices may change without notice. Prices at checkout are final and include VAT (if applicable) but exclude shipping, customs duties or import charges unless otherwise specified.

You agree to provide current and accurate billing information and to update this information promptly.

By providing payment details, you warrant that:

  • the information is correct
  • you are authorised to use the payment method
  • your payment provider will honour the charges
  • you will pay all applicable charges, taxes and fees

Promotions may have separate terms. Where conflicts exist, promotion-specific terms prevail.

SECTION 5 – SHIPPING AND DELIVERY

Delivery times are estimates only and are not guaranteed.

Once your order is handed to the carrier, risk of loss passes to you. We are not liable for delays caused by couriers, customs, or events beyond our control.

International orders may incur customs fees, taxes or import duties, which are your responsibility.

SECTION 6 – INTELLECTUAL PROPERTY

All content, branding, text, images, graphics, media, designs and trademarks on the Services are owned by Sjoe Daily or its licensors and are protected under applicable intellectual property laws.

Shopify trademarks belong to Shopify. Other marks displayed belong to their respective owners.

All rights not expressly granted are reserved.

We may provide access to third-party tools or integrations offered “as is” and “as available.” We do not monitor or control these tools and accept no liability for your use of them.

Your use of optional tools is entirely at your own discretion and subject to the third party’s terms.

Our Services may contain links to external websites or content. We are not responsible for examining or endorsing such content and are not liable for any harm or loss arising from your access to or use of third-party websites.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Sjoe Daily is powered by Shopify. This section must remain unchanged per Shopify’s requirements.

While Shopify hosts our store, all sales are made directly between you and Sjoe Daily. Shopify is not responsible for any transactions, products purchased, or issues arising from your use of the Services.

You expressly release Shopify from any claims or liability related to your transactions with Sjoe Daily.

SECTION 10 – PRIVACY POLICY

Your personal information is handled in accordance with our Privacy Policy, as well as Shopify’s Privacy Policy.

Because our Services are hosted on Shopify, certain data may be stored or processed in countries outside your own. By using the Services, you consent to this processing.

SECTION 11 – FEEDBACK

If you submit feedback, reviews, suggestions, or content (“Feedback”), you grant us a perpetual, worldwide, royalty-free licence to use, reproduce, modify and publish it for any purpose.

You warrant that:

  • you own the Feedback or have the rights to provide it
  • it complies with these Terms
  • you are not impersonating anyone
  • it contains no harmful or illegal content

We may remove Feedback at our discretion.

SECTION 12 – ERRORS, INACCURACIES & OMISSIONS

Occasionally, our Services may contain errors such as typographical mistakes, inaccuracies, or omissions relating to prices, promotions, product descriptions, or availability. We reserve the right to correct these without prior notice, including after an order has been submitted.

SECTION 13 – PROHIBITED USES

You may not use the Services:

  • for unlawful or malicious purposes
  • to infringe on intellectual property
  • to harass, harm, defame, or threaten others
  • to transmit harmful code
  • for fraudulent or misleading conduct

Provisions intended to survive termination (IP, indemnity, liability limits, etc.) will continue to apply.

Your use of the Services is at your own risk.

You agree to indemnify and hold harmless Sjoe Daily, Shopify, and their affiliates from claims, losses, damages or liability arising from your breach of these Terms or misuse of the Services.

SECTION 18 – SEVERABILITY

If any provision is found unenforceable, the remaining provisions continue in effect.

SECTION 19 – WAIVER & ENTIRE AGREEMENT

Failure to enforce any provision is not a waiver.
These Terms, together with referenced policies, form the entire agreement between you and Sjoe Daily.

SECTION 20 – ASSIGNMENT

You may not transfer or assign your rights without written consent. We may assign our rights without notice.

SECTION 21 – GOVERNING LAW

These Terms are governed by the laws of South Africa, and any disputes shall be heard in the courts of Cape Town, unless otherwise required by consumer protection laws in your country of residence.

SECTION 22 – HEADINGS

Headings are for convenience only and do not affect interpretation.

SECTION 23 – CHANGES TO TERMS

We may update these Terms at any time. Material changes will be communicated in accordance with applicable law. Continued use of the Services constitutes acceptance of updated Terms.
